1. AGREEMENT TO TERMS
By accessing or using GuardianAI ("Service") at guardianai.tech, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service. If you are using the Service on behalf of an organization (e.g., a school or company), you represent that you have the authority to bind that organization to these Terms.
2. DESCRIPTION OF SERVICE
GuardianAI provides an AI-powered violence and anomaly detection platform for educational institutions and other organizations. The Service includes a web-based Live Demo for uploading video content for real-time analysis, a web dashboard for authorized administrators, an on-premise software solution for institutional deployment, and Telegram-based alert notifications.
3. ACCEPTABLE USE
You agree to use the Service only for lawful purposes. You must not upload video content you do not have the right to share, attempt to reverse-engineer or extract the underlying AI models, use the Service to surveil individuals without their knowledge in violation of applicable law, use the Service for any purpose other than security monitoring and violence detection, or attempt to gain unauthorized access to any part of the Service or its infrastructure.
4. LIVE DEMO — VIDEO PROCESSING
When using the Live Demo feature, you explicitly consent to the following: video frames you upload are transmitted to third-party GPU infrastructure (Modal.com) for real-time AI processing; all video frames are immediately discarded after analysis — we do not store, archive, or retain any video content; by uploading video, you confirm you have the right to submit that content for processing; you must not upload footage of individuals without their consent, or footage that violates any applicable privacy law.
5. INSTITUTIONAL USE (ON-PREMISE)
For educational institutions and organizations deploying GuardianAI on-premise, the institution acts as the Data Controller and is solely responsible for obtaining necessary consents from staff, parents, and guardians for video surveillance. GuardianAI acts as a Data Processor only — processing data strictly on behalf of and under the instructions of the institution. Video streams processed on-premise do not leave the institution's local network. The institution is responsible for compliance with all local laws regarding video surveillance in educational settings.
6. ACCOUNTS AND ACCESS
You may register using Google OAuth. You are responsible for maintaining the security of your account and must not share credentials with others. We reserve the right to suspend or terminate accounts that violate these Terms. You must be 18 years of age or older to create an account.
7. INTELLECTUAL PROPERTY
All rights, title, and interest in the GuardianAI platform — including its detection models, web dashboard, algorithms, and branding — remain the exclusive property of GuardianAI. These Terms do not grant you any ownership rights in the Service.
You retain ownership of any video content you upload. By uploading content, you grant GuardianAI a limited, temporary license to process that content solely for the purpose of providing the Service.
Data for Model Improvement: For on-premise deployments, you grant GuardianAI a perpetual, worldwide, royalty-free license to collect and use fully anonymized spatial and kinematic data (e.g., skeletal keypoint coordinates) generated by the Service. This data contains no visual or biometric identifiers and is used exclusively for the ongoing training, testing, and improvement of GuardianAI's machine learning models.
8. DISCLAIMER OF WARRANTIES
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. GuardianAI does not warrant that the Service will be uninterrupted or error-free, that detection results will be 100% accurate, or that the Service will meet your specific security requirements.
The system is designed to assist, not replace, human security personnel. GuardianAI is not liable for any incidents that occur regardless of whether the system did or did not generate an alert.
9. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, GuardianAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or personal injury, arising from your use of or inability to use the Service.
10. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless GuardianAI and its developer(s) from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, including but not limited to your failure to obtain required legal consents for video surveillance, or your unauthorized use of the Service.
11. PRIVACY
Your use of the Service is subject to our Privacy Policy, available at https://guardianai.tech/privacy. By using the Service, you agree to the collection and use of information as described therein.
12. CHANGES TO TERMS
We reserve the right to modify these Terms at any time. We will notify users of material changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.
13. TERMINATION
We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately.
14. GOVERNING LAW
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kazakhstan, without regard to its conflict of law provisions.
